TERMS AND CONDITIONS OF ENGAGEMENT

1. Identification of the Holder and Object of the Contract

In compliance with the provisions of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE), as well as Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data (RGPD), users are informed that this website and the associated training platform are owned by:

This document regulates the terms and conditions applicable to the contracting of audiovisual training courses for cinemas offered through the Cinemanext Spain S.A. website.

2. Recruitment Process and Conditions of Access

The contracting of the courses offered on the Cinemanext Spain S.A. training platform is formalised entirely through the website and is in accordance with the following procedures:

2.1. Prerequisites

The user shall:

  • Be of legal age and have full legal capacity to contract.
  • Accept these terms and conditions at the time of contracting.
  • Provide truthful and updated information on the registration form.

2.2. Recruitment procedure

  1. Selection of the course and addition to the shopping cart.
  2. Filling in the billing and payment details.
  3. Confirmation of the order and payment using the enabled methods.
  4. Receipt of the confirmation email with access credentials and course details.

2.3. Conditions for access to training

  • Online courses: Access to the training content will be activated automatically after confirmation of payment.
  • Face-to-face courses: An email will be sent with instructions, dates and place of delivery.

The courses are personal and non-transferable, and Cinemanext Spain S.A. reserves the right to revoke access in the event of any fraudulent use.

3. Economic Conditions and Turnover

3.1. Price and transaction currency

All course prices are expressed in euros (€) and include applicable indirect taxes in accordance with current tax legislation in Spain.

3.2. Methods of payment

The payment methods available are:

  • Credit/debit card (Visa, Mastercard, American Express).

3.3. Invoicing

The user may request an invoice in electronic format by sending an e-mail to proyecson@cinemanext.com with their fiscal data and order number.

4. Cancellation, Refunds and Right of Withdrawal Policy

4.1. Right of withdrawal

In accordance with article 103 of the General Law for the Defence of Consumers and Users, digital courses are not subject to the right of withdrawal once the platform has been accessed.

However, cancellation and reimbursement may be requested in the following cases:

  • If the course has been cancelled by Cinemanext Spain S.A. or has technical problems that prevent it from running.

4.2. Procedure for reimbursement claims

To manage a return, the user must contact Cinemanext Spain S.A. at proyecson@cinemanext.com, indicating:

  • Order number.
  • Reason for the request.
  • Documentary evidence (if applicable).

The refund, if approved, will be processed within a maximum of 7 working days using the same payment method used for the purchase.

5. Intellectual Property and Restrictions on Use

5.1. Ownership of content

The materials and contents of the courses are protected by intellectual and industrial property regulations, and their reproduction, distribution, public communication or modification without the express authorisation of Cinemanext Spain S.A. is prohibited.

5.2. Restrictions on use

The user undertakes to:

  • Use the content exclusively for your personal or professional training.
  • Not to share access credentials with third parties.
  • Not to record, download or distribute the materials without authorisation.
  • Not to use the course for commercial or unfair competition purposes.

Failure to comply with these rules may result in revocation of access without refund and possible legal action.

Cinemanext Spain S.A. offers users a support service for queries related to the platform and access to the courses:

7. Applicable Law and Dispute Resolution

These Terms and Conditions are governed by Spanish law. In the event of any dispute arising from the interpretation or execution of the contract, the parties shall submit to the courts of Paterna, unless the law provides for another applicable jurisdiction.
